POOL & FACILITY RULES/REGULATIONS
The following rules and regulations are for the protection and benefit of all, including to ensure safe and sanitary operations of the pool facilities operated by The Mission Highlands Swim Club (the “Club”) located at 41900 Palm Ave., Fremont, CA (the “facility” or “facilities”). Your cooperation in abiding by these rules will benefit each member using the facility. Members shall inform their children and guests to observe all rules and regulations, including any instructions provided by the lifeguards and/or management. These rules/regulations may be revised or amended at any time at the sole discretion of The Board. If any of these rules are broken, membership is subject to review and suspension.
GENERAL:
- Rules/regulations will be enforced during all hours of operation.
- There are 24/7 security cameras that will be checked if needed due to complaints, damage, etc. Anyone at the facility is subject to surveillance.
- Lifeguards are present for members’ safety, but the Club is not obligated to provide lifeguards.
- Lifeguards may enforce any other rules they feel are necessary to keep the facility safe.
- Do not leave items overnight. Any personal items left overnight will be discarded. No exceptions.
- Individuals failing to comply with the pool rules or health and safety guidelines, or who are unsafe, unruly, or disrespectful will be asked to leave by the lifeguards, management, or The Board.
CHECKING IN:
- When lifeguards are present, ALL members and their guests must check in before entering.
- Caregiver(s) must be identified on the membership account and may only check in with a member present.
- Members must provide lifeguards with the last name the account is under, which member is present, and number of guests.
- Members may be asked to show ID.
GUESTS:
- There is a $5 charge per guest at the facility.
- Available guest passes from a member’s account may be used instead.
- There is a maximum of 10 guests per visit per membership household.
- Members must inform guests of the pool rules.
- Members are responsible for the behavior of their guests.
- Members cannot leave the pool when they have guests.
- Lifeguards may check the number of guests at any time while they are on duty.
- Guests without fees paid or guest pass will not be covered by insurance and considered to be trespassing, and will be liable for all property damages, injuries, or other adverse events.
BEHAVIOR:
- Be courteous to others.
- If you have an issue with another member or their guest, please advise the lifeguard of the situation.
- No rough housing, pushing, hitting, dunking, spitting, fighting, profanity, excessive yelling, or screaming is allowed.
- No running on the pool deck area.
- No front flips, back flips, spin jumps, and/or back dives.
- No diving.
- Non-swimmers must remain in the shallow end of the pool, unless accompanied by an adult.
- To ensure swimmer safety, lifeguards may require a swim test to demonstrate ability before swimmers are allowed to swim unaccompanied by an adult or in the deep end.
ATTIRE:
- Only swimming attire is permitted to be worn in the pool.
- Children who are not potty trained must always wear a swim diaper.
- Members must change in the bathroom.
- The only exception is for children under the age of 3, who may be changed on the pool deck, BBQ area, etc.
TOYS:
- No hard balls, water balloons, or rafts allowed in the pool.
- Large flotation devices prohibited.
- Small flotation devices are allowed.
- Swim fins are allowed in the pool, but swimmers may not walk on the concrete with them. They must enter the pool and then put the fins on.
- No water guns/squirting toys are allowed in the pool or on the pool deck. Water guns/squirting toys, balls, and other toys are permitted on the lawn only and with adult supervision so long as the use of such toys does not unreasonably interfere with another member’s use and enjoyment of the facilities.
LAP LANE:
- Only used for lap swimming. Those 16 years and older have priority of the lap lane.
ADULT SWIM:
- You must be at least 16 years old and a proficient swimmer to participate in Adult Swim.
- Adult Swim occurs during the last 15 minutes of each hour.
- Lifeguards will make the Adult Swim announcement every 45 minutes.
- Adult Swim is not in effect when there are no lifeguards on duty.
- During Adult Swim, kids under 16 years old must leave the pool in a timely manner, regardless of whether their parents are in the water.
- Kids under the age of 16 years old must be behind the brick. No feet in the water, no sitting on the stairs, no sitting on the brick for the full duration of Adult Swim.
- Parents may take an infant under the age of 2 in the pool as long as they are always holding them.
- Adult swim is under full discretion of the lifeguards and can be cancelled (i.e. if there are no adults swimming, etc.).
EQUIPMENT:
- Kickboards/pool noodles may be borrowed from the Club but must be returned to storage when done.
- Rescue equipment is for rescue use only.
- Do not use the equipment in the swim team’s shed.
- Corn hole, balls, ping pong equipment, etc. may be checked out from the lifeguards but must be returned when done.
- There is a 15-minute time limit on the ping pong table if there are others waiting.
- There is a 30-minute time limit on the volleyball court if there are others waiting.
- No hanging/sitting on the lane lines.
- No hitting anyone with noodles.
- No standing on flotation devices.
- No hanging on the volleyball net.
FACILITY:
- No smoking/vaping at the entrance, area leading up to the gate, or inside the facility.
- Food and drinks are not permitted within 6 feet of the pool.
- Shoes/slippers cannot be left at the entrance of either end of the stairs.
- Pets, skateboarding, rollerblading, roller shoes, scootering, and biking are not permitted.
- Glass containers are only allowed in the BBQ area.
- Alcohol consumption is permitted at the facility. Please drink responsibly.
- Members/guests are not permitted in the guard office, mechanical room, or storage room without prior approval.
- Please be mindful of the volume on your devices when listening to music, watching a video, online gaming, etc. Lifeguards may ask for the volume to be lowered if it is disruptive to others.
- There is a 5-minute limit in the showers.
- The wading pool is off limits until further notice.
BBQ/PATIO AREA:
- First-come, first-serve, unless the area has been reserved by a member for a party.
- During party reservations, members still have access to 2 grills and 2 tables.
- Please make sure you turn off and clean the grills after you use them.
KITCHEN AREA:
- Do not take things out of the fridge that are not yours.
- Clearly label anything you put in the fridge.
- Remember to take all your items when leaving. The fridge is cleaned out at night. Anything left behind will be discarded.
- Alcohol should be kept with the member in a cooler for safety issues. Do not store alcohol in the fridge.
WHEN LIFEGUARDS ARE NOT ON DUTY:
- Swim at your own risk.
- Clean up after yourself.
- Close the umbrellas when you leave.
- Return any furniture that you have moved to its original location.
- If you are the last person to leave the facility, make sure all doors are closed.
KEY FOB:
- One (1) key fob is issued to a membership household.
- Sharing a key fob with someone not listed on membership is prohibited and subject to cancellation of membership.
- Key fobs are to be used during facility hours when lifeguards are not present.
- There is a $10 replacement cost if your key fob is lost.
SWIM LESSONS:
- Swim lessons are taught by current Highlands lifeguards only.
- Only members may take lessons at the pool.
- Members cannot bring in their own swim instructors.
- No lessons allowed to start after 11am on Saturdays, Sundays, or Holidays.
- Other lesson times may be restricted at the discretion of the Board and subject to change.
- There is a maximum of 2 lessons that may occur at the same time.
- There is no teaching from outside of the pool (i.e. stroke clinics).
PARTY RESERVATIONS:
- The covered patio area can be reserved for parties up to 30 guests (not including the host household).
- 4-hour max reservation.
- $60 booking fee must be paid to the treasurer following receipt of the invoice.
- The $60 booking fee is refundable if the party is cancelled with 5 days or more advance notice of the event.
- $5 per non-member fee will be collected on the day of the party or invoiced by the Board Treasurer after the party (guest passes may be used).
- $150 incidental deposit check must be submitted by the start of the party.
- The check will be destroyed after the party if there are no damages to the facility.
- Reservations are on a first (signed) contract, first reserved basis.

MEDICAL PRECAUTIONS:
- No one having a communicable disease and whom is in an infectious state is permitted to enter the facility. * No one having diarrhea in the last 14 days shall enter the water. *These rules/regulations shall not be applied in an unlawful or discriminatory manner.
- If any person requires reasonable accommodation, please let the Board of Directors know.
ASSUMPTION OF RISK LIABILITY RELEASE:
Users understand that their use of the facilities has certain inherent risks, including, but not limited to slipping, falling, drowning, being struck by objects or persons, and other types of bodily injury, sickness, disease, or death. In addition, Users acknowledge that the novel coronavirus (“COVID-19”) was declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious, and use of the facilities carries with it certain inherent risks related to COVID-19 transmission that cannot be eliminated regardless of the care taken to avoid such risks, and the Club cannot guarantee that Users will not become infected with COVID-19. Further, use of the facilities could increase Users’ risk of contracting COVID-19, and such exposure or infection may result in quarantine, personal injury, illness, disability, and/or death, the exact nature of which are not currently ascertainable. Users voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to Users, guests, and children, including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense of any kind that Users guests, and/or any children may experience or incur in connection with the use of the facilities. Each User, on his/her own behalf, and on behalf of each child and guest, hereby releases, covenants not to sue, discharges, and holds harmless the Released Parties of and from any liabilities, claims, actions, damages, costs, or expenses of any kind arising out of or in any way related to the use of the facilities. Users understand and agree that this release includes any claims based on the actions, omissions, or negligence of the Club (and any of its agents, officers, directors, employees, vendors, and any other person acting on the Club’s behalf).
